Welcome to the legal policies hub for The Ritz Herald (collectively with affiliates, “We,” “Us,” “Our,” or “the Company”). These policies govern your access to and use of our websites, newsletters, apps, and related services (the “Services”).

1. Acceptance of Terms

These Terms form a binding agreement between you and The Ritz Herald. You represent that you are of legal age (or have parental/guardian consent if under 18/16 depending on jurisdiction) and agree to comply with these Terms and applicable laws.

2. Permitted Use

Use the Services for personal, non-commercial purposes only (e.g., reading articles, subscribing to newsletters, sharing links). You may view, download, or print content for personal use, retaining all notices.

3. Prohibited Use

Do not:

  • Use for illegal purposes or violate laws (including data privacy).
  • Copy, reproduce, distribute, or create derivatives without permission.
  • Scrape, mine data, or use bots without authorization.
  • Post spam, harassment, defamation, or infringing content.
  • Introduce malware or disrupt services.
  • Impersonate or misrepresent.
  • Use AI to generate/alter content violating IP rights.

Violations may lead to termination, removal, or legal action.

4. User Content and Accounts

If you submit content (comments, etc.) or create an account, you grant us a non-exclusive, royalty-free license to use it. You are responsible for your account security.

5. Intellectual Property

All original content is owned by us or licensors and protected by law. Unauthorized use prohibited.

6. Third-Party Links and Content

Services may link to or embed third-party content (e.g., YouTube, social media). We are not responsible for them.

7. Payments/Subscriptions (if applicable)

Processed securely via third parties. Auto-renew unless canceled. Refunds per policy.

8. Limitation of Liability

To the maximum extent permitted by law, we disclaim indirect/consequential damages. Total liability limited to $100 or amount paid (if any).

9. Indemnification

You indemnify us for claims from your violations or misuse.

10. Governing Law

Governed by New York law. Disputes via binding arbitration in New York (except small claims).

Introduction

The Ritz Herald is a communications group empowering journalists, PR, and marketing professionals. We are the data controller under GDPR/UK GDPR.

This applies to our Websites, apps, newsletters, etc.

Definitions

For the purposes of this Privacy Policy:

  • Account means a unique account created for You to access our Service or parts of our Service.
  • Business, for the purpose of the CCPA (California Consumer Privacy Act), refers to the Company as the legal entity that collects Consumers’ personal information and determines the purposes and means of the processing of Consumers’ personal information, or on behalf of which such information is collected and that alone, or jointly with others, determines the purposes and means of the processing of consumers’ personal information, that does business in the State of California.
  • Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to The Ritz Herald, 1177 6th Avenue, 5th Floor, New York, NY 10036, United States. For the purpose of the GDPR, the Company is the Data Controller.
  • Consumer, for the purpose of the CCPA (California Consumer Privacy Act), means a natural person who is a California resident. A resident, as defined in the law, includes (1) every individual who is in the USA for other than a temporary or transitory purpose, and (2) every individual who is domiciled in the USA who is outside the USA for a temporary or transitory purpose.
  • Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.
  • Country refers to: United States.
  • Data Controller, for the purposes of the GDPR (General Data Protection Regulation), refers to the Company as the legal person which alone or jointly with others determines the purposes and means of the processing of Personal Data.
  • Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
  • Do Not Track (DNT) is a concept that has been promoted by US regulatory authorities, in particular the U.S. Federal Trade Commission (FTC), for the Internet industry to develop and implement a mechanism for allowing internet users to control the tracking of their online activities across websites.
  • Personal Data is any information that relates to an identified or identifiable individual. For the purposes of GDPR, Personal Data means any information relating to You such as a name, an identification number, location data, online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity. For the purposes of the CCPA, Personal Data means any information that identifies, relates to, describes or is capable of being associated with, or could reasonably be linked, directly or indirectly, with You.
  • Sale, for the purpose of the CCPA (California Consumer Privacy Act), means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a Consumer’s personal information to another business or a third party for monetary or other valuable consideration.
  • Service refers to the Website.
  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
    For the purpose of the GDPR, Service Providers are considered Data Processors.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • Website refers to The Ritz Herald, accessible from https://ritzherald.com, and its publishing ecosystem:

  • For providing Services, analytics, marketing (with opt-out), AI personalization (low-risk, transparent per EU AI Act), legal compliance.

    Legal bases: Consent, contract, legitimate interests, obligations.

Categories (last 12 months): Identifiers, internet activity, inferences. No sales/sharing of sensitive data

Children's Privacy

Not for under 13 (COPPA). Delete if discovered.

We use essential, performance, functional, and targeting cookies (e.g., Google, social embeds). Consent banner for non-essential (GDPR/ePrivacy). Manage via browser.

Content Sources and Third-Party Materials

Most materials (articles, announcements, graphics, images) are supplied by press release services, newswires, PR agencies, corporate submitters, and other third-party sources. We distribute them as received or with minimal formatting, representing the submitters’ views—not ours. We do not verify accuracy, legality, or truthfulness and act as a platform on an “as is” basis. May include sponsored/paid content.

Reporting and Removal of Unlawful or Infringing Materials

If you believe content (text, graphics, images, videos) is unlawful (e.g., copyright/trademark infringement, defamation, privacy violation, illegal material like non-consensual images, hate speech where prohibited, or other violations), contact us for review and potential removal.

Provide:

  • Specific material (URL/location).
  • Why unlawful (evidence).
  • Your contact info (proof of rights if claiming ownership).

We may remove content at discretion, per court orders, etc.
